Oh wow, that is terrible. I just looked and that dealer actually has pretty high ratings on Dealer Rater, so this seems surprising (and worrying for the rest of us too). They will only sell you the car if you trade in with them? Do you have an invoice from them, or some other document showing the deposit and amount to pay? If so, I would call Kia Corporate pronto. That is just awful.
Hi where do you see the dealer rating? they should have a horrible score after what they did to me! I gave a $500 deposit back on December 4th, 2021. They printed out the final price, with my order number, name, and address.... they told me you'll just pay MSRP since you are custom ordering..we said we can pay cash for it... 7 months later the dealer manager (ZACK) of Kia of Beavercreek changed his mind and said if you don't trade in your (like new 2017 Hyundai Tucson with 37,000 miles) he WILL NOT sell us the Sorento. We asked him to put it in writing that it was required to trade in a vehicle to get the Sorento..he refused... so obviously that's a lie.. he blatantly said "I can make more money selling this car to someone else"......what a disgusting thing to say to a customer. I called Kia Motors America to complain...their response: "we don't deal with he dealers, we only do orders and warrenty"....

We will be taking legal action but also going to the news media about this situation... we also called and Martin's Group of dealers in bowling green kentucky who owns Kia of Beavercreek..they said they would call me back with a resolution but i doubt it.

Like i said, i would cancel your orders ....it's been 7 months and now this happens to me... think about what they'll do to you. My dad told the manager that we are going to get a lawer...the manager said "go ahead" and then my dad was so angry that he said he's going to call the police... the sales person said "haha they're not going to do anything".... how is this ok?!?

My dad is currently on his way to the dealer with a police escort to get the $500 deposit back.

Your dad is going there with a police escort? Sorry but going to say "I doubt it" on that. This is a civil matter and police should not even be involved unless they are enforcing a judgement. They can not force the dealership to turn over money like that. Also even calling the police is a waste of their resources and could actually turn out worse for your father if they trespass him while he is there.

you think we were trying to have the manager arrested? uh no, that's a stretch. We went to the police station and they were just as disgusted by the dealer as we were. So much so that a female officer decided to call the dealer to explain the situation and the sales associate hung up on her. They really "back the blue" at Kia of Beavercreek Ohio huh?...disrespecting a police officer and a woman at that. The police officer then asked if she could escort my dad to the dealership to get the $500 back. They told her "we don't want to deal with him" as if we somehow broke the agreement?? When the police officer walked in, all the customers looked and the manager looked embarrassed.. THAT was what we wanted.

If you were me what would you do? This dealer basically used me as a mule to order a car that he was NEVER going to sell to me. In fact we believe that he was never going to call us after the car came in saturday. We believe he was going to go ahead and sell the car and keep telling us "it never came" until we cancelled the order and got our $500 deposit back.

To be honest I am not sure what I would do in your position since I do not know all the facts around your original deal that you worked out with the dealer. In my case I have a signed purchase order showing the sales price and then the Tax, title, and license is filled in "to be determined". The doc fee is on there. There are no other conditions listed as part of the sale. In the VIN number spot is my order ID. Both the GM and I signed it. I did not put a deposit down as they do not require one upfront. However I did sign another form and provided my credit card stating that if I do not accept the vehicle they custom ordered for me they they have the option to charge me a $500 fee.

So I am assuming that you still have not gotten back the $500 from last night. What I would do is calming call the dealer back and either ask them if you can come down and speak to them again or settle the matter over the phone. I would not have your dad there since things got heated. Request a refund and expect it to be in the form of a check sent by their accounting department which could take a few day. If they refuse then send them a demand letter by certified mail. If you know any lawyer or paralegals then as them for advice on writing the letter. Examples can be found online as well. The demand letter should include that the next course of action will be a lawsuit. If that fails then contact your small claims court and file a claim seeking the $500 plus court cost. You can even ask for a few dollars extra for your time in doing all this but I would just do the $500 plus court cost. You sound like you have a good case. There is a very good chance they will take care of it before it goes to court and if not then you will have a judgment in your favor if you win.

Also look at contacting your state Attorney Generals office or the department that regulates dealers. Good luck.

Update: I called the Media and they're going to do a story/investigation about this incident at Kia of Beavercreek, Ohio

They wanted you to trade in your vehicle to them, because they would low-ball your trade and make even more money on the deal. I am thankful you did not cave into their deceptive trade practices. Hope it all works out for your family, @DonMunaweera. The dealership stepped over the line and now they are going to lose more than just one deal.

I just got off the phone with our dealer. We ordered last January.

He told me that Kia informed them that all PHEV's slated for the midwest are going to be re-allocated to the East and West coast dealers, and that if I wanted one I should expect to wait "at least 18 more months"... I got my deposit back.

Bummer.

Bummer.

Well that really sucks. Wonder how far the Midwest bubble extends to and why.

Check my math, but combined that is well over 2 years - and then you don't even know if you would get it! KIA had better get their act together as damn few people will be willing to wait 2 years for a new car. And that is just handing over sales to other car companies for those that must have a PHEV.

I know that before I got my X-Line, I was thinking seriously of ordering a PHEV. I don't remember now what the exact wait time was, but it was like a year or slightly less - a lead time I was unwilling to wait - AND I didn't believe them then, and that was only two months ago.
