You are discribing a clasic brake servo problem, there could be other reasons, drawing in air for one, but I'd stake it's a servo problem.
I'f your taking it to court get yourself armed with an independant report,
( not from a garage ), costs you'll get it back if it goes in your favour.
However in the first instance avoid court if you can, talk to Kia UK, you might have to thump desks.
