Every time they change lawyers, is a new retainer fee they have to pay. They are probably looking for an attorney who will try to put up a fight. Most attorneys won't waste their time fighting when there's no chance of getting anywhere. They'll save everyone some money and settle. Unfortunately, at this point, the car has been sitting for 5 months, and the tires are shot, brakes are rusty, and all kinds of bad things are about to happen to it when the snow flies. The longer they stall, the more the car will cost them to refurbish after they have to buy it back. They're going to spend over $75,000 on this case, and lose it anyway. They should have just replaced the engine back in July and admitted it was an engineering flaw.
Just had my spark plugs replaced, two of them had chipped, not sure how that happens unless it was a bad batch. Took 2 weeks to find out that was the issue, well i got a new ECU map, new engine coil#3 and 4 new plugs. She is back to her full glory. Oh, and the Turbo died after around 7-8K, took 3 -4 weeks to get the final gasket on the new turbo. Well so far that's my history, she is at 22K and had her for 14months. As much pain she has given me i still love that truck.
Breaking the insulators on plugs most likely was the result of detonation in the combustion chambers, caused by errors/failures of the engine management. Ask yourself where the very hard, sharp, heat-proof chips from the plugs went, and what they may have done to the engine while rattling around. Supercharged engines, by turbine or blower, are very prone to many kinds of breakdown/damage. I'd still like to have one someday, but I'm glad I didn't get an SX when I bought the 2011.
Supercharging is the current rage with many automakers and is likely to increase in the effort to provide sporty vehicles while saving fuel.

That's exactly what breaks the plugs. I even had my car in for service 2 months after I bought it, because I could hear the sound of detonation in the engine. They told me it was "normal operation of the direct injection system". Basically, "huh? Scantool no find problem, no idea what wrong, durrr". Kia's service departments only want to do bare minimum work. Instead of figuring out what's causing all these turbo engines to eat plugs, they'd rather just replace the plugs, and blame the consumer when one of the plugs' chunks puts a hole in the cylinder.

Haha, well, apparently I'm finally striking a nerve with them. Their time wasting forced my attorney to file with the County, and force their hand. So, while we've been waiting, I've been attempting to be a P.R. nightmare for them. I've been bombarding their tweets with my comments, and their facebook. No lies, nothing bad, just poking a bit with facts, and my experiences with them. They got so sick of me, they called my attorney. He told them to just deal with it. So, they actually blocked my twitter account! lol. So, I just made another one. The little guy will not be silenced with their mistreatment . Like I told them. If they would have just admitted their engineering fault, and fixed it, this wouldn't be happening. Ugh. It's a good vent for my frustration with them. And I really hope they never pull this on any of their customers again for your guy's sake!
They don't seem to be using common sense. You have to be costing them sales, but that doesn't seem to matter. I'm guessing that your bumping up against some cultural differences. I've experienced similar attitudes dealing with China electronics vendors. They really have no concept of customer service, it's all about "saving face". I don't think they will give in on this, your going to have to rub their nose in it. At this point, because of their intransigence, I think I'd be asking for punitive damages.
In any event there are a lot of us pulling for you. Hang in there.

Well, my attorney decided the waiting was worth some paperwork punishment, and filed a discovery against them. Now, my car is back in the service booth, hood up, and taking up space at the dealer. And their attorneys have to give a full report to my attorney. We're waiting for a court date with the county, since Kia refuses to acknowledge settlement talks.
