I'm pushing 29,000 miles, after nearly 15 months of ownership (with 4 miles on the odo). Drove 2400 miles out west, averaged 35mpg @ 80mph. Drove another 2400 miles to the East Coast, 40mpg @ 70mph. I got the free Kia money ($192 or so), and have absolutely *no* complaints with the way Kia handled this. I also did *not* buy it based on "fuel efficiency". I bought it because of the reliability factor (my second Kia), and I like the way it looks.
*Any* car these days loses value as soon as you drive it off the lot. It's been that way forever. Oh...and as far as any "small claims" goes..the only ones to benefit off of that will be the lawyers.
Honestly, if you indeed "hypermiled" your car you would exceed the estimates. And let me point out - it does not matter how many years you have been driving. It matters how, where, and when you drive.
Well....my attempts at hypermiling were admittedly feeble. lol
As for the number of years driving, my point was that in 35 years of driving you learn a thing or two.

At first I was a little upset with the mileage of my Rio5. Now I just don't care. I see the car for what it is. A hot looking hatch that is absolutely loaded. Especially at this time of year when by the time I get to the end of my street the steering wheel and seat are toasty warm.
When I bought the Rio5 I also looked at the Sonic, Fiesta, Fit and Yaris. A comparatively equipped Sonic or Fiesta was a few thousand more. None had a backup camera and the Fiesta had 20hp less. The Fit was way overpriced for a bare bones (compared to the Rio5) dull box with a weak motor. The Yaris didn't even warrant a test drive. Walked into the showroom, took one look at one and walked out.
Does it bother me that I am not getting the advertised mileage? Yes. But I forget about that when I walk away from the car and turn around to look at it. Nicest looking small car out there.

in australia we received no such compensation offer, and i couldn't care less. On average, working it out properly my Rio averages 7.9L/100KM or ~30MPG US from doing mostly bad peak hour traffic and the occasional (monthly) highway trip. It rides well enough, is well appointed and outclasses every other equivalently priced car available here.
what's not to like?
borrow my v8 for a few weeks, use that as a daily work car like i did, then come and complain
i've had my rio5 for 2.5 months now, and 2300 miles, i drive 21 miles each way to work in so. cal traffic, consisting of stop & go for about the first 12 miles or so. i've been doing the math when i fill up my tank, and have been getting anywhere between 31-33.5 mpg. the "avg" on the trip meter usually hovers around 34-34.7 mpg.
i'm enjoying my little rio5, it does what i need it to do, i never expected it to get the claimed 40mpg.
since running premium (95RON) in my Rio for the last 20 or more tanks, not only have i eliminated all pinging and increased economy/throttle response, but the economy figures the car shows are now exactly the same as when i work them out properly. For the first 10,000KM or so the car would say it got about 7.5 when it was really 8.5 and so on. Now they're pretty much bang-on.
