Warranty and first service ?

My daughter bought a 2012 Rio 1.25air 3-dr in march of this year, online and from a reputable Rio dealer in the South West, the price was good, I enqured for her about the fine details on the car, obviously my first question was has it got FSH ? The sales manager assured me it had, they had supplied the Rio from new and done all the servicing, the previous one owner had part exed for a new Kia, part of the deal was free delivery, it was paid for and duly delivered, I checked it over and checked the paperwork including the service history and all seemed ok, so ..... after a routine enquiry at my local Kia dealer today about the gearbox and how the kia warranty works they checked online and advised me that it was due a 40,000 mile service and it would be the 4th service. I seemed to remember only seeing 3 stamps in the service book and it had been serviced before delivery at 39,283mls, it's only at 40,340mls now so I checked when I got back and sure enough 3 services the last two at 10,000 mile intervals but the first one a oil change at 10,000mls had not been done, instead the first stamped service was at 12mths and 18,000 miles. i have not phoned the kia dealer yet but if someone has screwed up with the first service what redress would I have as the car was sold not as described, and, is the warranty now void ?

Welcome, the dealer was technically correct in disclosing that it HAD infact a service history, whether you are satisfied about how complete it is, is a matter the buyer should look at BEFORE taking delivery.
Not sure about warranty law in UK, I doubt warranty would be void from missing one service, they would have to prove that was the one and only contributing factor to a failure.

Hi Danzvtil, Thanks for the reply. The dealer did not say it HAD a service history he said it had a Full Service History and the car was advertised on the internet as having a FSH ! From what i can gather a full and complete service history would have included a oil and filter change at 10,000mls or 12mths whichever came first, it did not have this service so technically it was incorrect to advertise the vehicle as having such when in fact it had PSH ( Part Service History ). I have spoken to the dealer who agreed the oil change was done late ( 18500mls ), in my book that's not late it's missed because at 18500mls the car is in fact having it's 20,000 mile service done early ! the dealer tried to reassure me that in all probability Kia would honour the warranty if a future claim was made, but that's like saying pick a playing card out of a deck and in all probability it will be a red card ! I am about to phone Kia UK to see what they say, I'll keep you posted as to the outcome.

Did I miss it somewhere? - what is the problem that needs fixed under the warranty? Or are you just looking for a bridge to cross before you've gotten there? If the latter - then somewhat like Danzvtil says, at the time you make a claim, Kia would have to prove that the missed/late service was the cause of their denial of that particular claim. Best you can do now is put the dealer on notice that you consider their advert/sales process was misleading - and that should Kia deny a future claim due to that missed service then you and your solicitor will be exceedingly miffed. Meanwhile let your daughter enjoy her new car?

Hi and thanks Dober ( i think ), your attitude obviously works fine for you, perhaps you're one of those lucky people where things don't go wrong and everything falls into place all on their own, great for you ! I, however like to cover my bets, and waiting maybe 2-3 years down the line to see if Kia honour's the warranty on an engine failure and getting the salesman ( if he still works for Kia ) to admit to what he said way back in 2015 when he sold the car just doesn't cut it for me thanks. The item i bought was not as described, if we traded the Rio in now there would be a big difference between what it's worth with FSH and what it's worth with PSH, if I'd have wanted to pay less then I'd have got a Rio with part or no service history and took a chance.

There isn't a problem now it's running just fine but if I get a problem in the future with it I'll be sure to check back in to Kia-forums and ask for Dober

Hi Jasper, Yeah ! that's what I'm talking about, the brand new car did over 50 miles every day for a year on the same oil and filter that was in it when it rolled out the showroom, and I'm supposed to wait till there's a problem ? We're not talking about the coolant level not being checked here, the Kia dealer who sold it either didn't notice the missed service or tried to tuck me up, either way I'm not happy, FJ Chalke from Mear can give me a full refund or i pick another car ..... end of !!
